The big news of the day is that the European Court of Justice has upheld the
Data Retention Directive against the challenge by the Irish Government in
Ireland v. Parliament and Council where it was claimed that it was adopted on the wrong legal basis. The decision doesn't consider whether the Directive is in breach of fundamental rights, and the
Digital Rights Ireland action on that basis will continue. More once I've had a chance to read the full decision.
Our only hope of any sort of democratic oversight when it comes to these issues is the European parliament. As for our champions of democracy on Kildare Street...
